Continuing a Hearing

Except on motion of the Court, no continuance shall be granted in the absence of proof of reasonable notice to, or consent by, the adverse party or the adverse party’s counsel. Failure to object to the continuance within a reasonable time after receiving notice shall be considered consent to the continuance. [Local Rule 56] Motions for continuance shall be submitted in writing with the proper caption and case number. A proposed entry shall be filed with the motion/application for continuance. If you are a Pro Se litigant, you may file LCPC Form 28.1. You must complete the forms in their entirety and to the best of your ability. The Pro Se Motion, the proposed Judgment Entry, and the Certificate of Service must be presented to the Court for filing at the same time. Failure to complete the documents may result in the Court taking no action on your filing. The Court may schedule your motion for a hearing with notice to all other interested parties. Service of motions shall be made by the moving party in compliance with all applicable Civil Rules. Costs associated with service made by the Court shall be paid by the moving party prior to the issuance of any Judgment Entry.
